Terms of Use

Welcome to Pet Mafia Club (“Pet Mafia Club”, “we”, “us”). These Terms of Use (“Terms”) apply to everyone who visits or uses petmafiaclub.com (the “Site”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. What Pet Mafia Club is

Pet Mafia Club is an online marketplace where breeders and sellers (“Sellers”) post listings for dogs and cats, and people looking for a pet (“Buyers”) can find them and contact the Seller. We do not own, breed, sell, ship or inspect any animal. We are not a party to any agreement between Buyers and Sellers. Any sale, deposit, delivery or other arrangement is made directly between the Buyer and the Seller.

2. Who can use the Site

You must be at least 18 years old and able to enter into a binding contract to create an account, post a listing or contact a Seller. You are responsible for following the laws that apply where you live.

3. Your account

• Give accurate, current information and keep it up to date.
• Keep your password private. You are responsible for everything that happens under your account.
• One person or business per account. Don’t create accounts to get around a suspension.

4. Rules for Sellers

If you post a listing, you agree that:

• You own the animal or are authorized to rehome or sell it, and the animal is available.
• All information is true and complete, including breed, age, health, vaccinations, registration and pedigree.
• Photos and videos show the actual animal and you have the right to use them.
• You comply with every law, license, permit and regulation that applies to breeding, selling, transporting and caring for animals where you and the Buyer are located, including minimum age rules for selling puppies and kittens.
• You will not act as a broker posing as a breeder, and you will not list animals from puppy or kitten mills.
• You follow our Family Code and treat Buyers honestly and respectfully.
• You will keep your listing’s availability (Available, Reserved, Sold) up to date.

5. Prohibited conduct

You may not use the Site to:

• Post false, misleading or fraudulent listings, or ask for payment for an animal that doesn’t exist.
• List any animal other than dogs and cats, or any animal that is illegal to sell where you are.
• Harass, threaten, spam or scam other users.
• Collect other users’ information for purposes not related to a pet you are buying or selling.
• Post content that is illegal, hateful, sexually explicit or infringes someone else’s rights.
• Interfere with the Site, try to break its security, or use bots or scrapers without our written permission.

6. Buyers

Buyers are responsible for their own decisions. Before paying anything, please read our Safety Tips: meet the animal in person or by live video, ask for records, and never send money by gift card, crypto or wire transfer to someone you haven’t met.

7. Content you post

You keep ownership of the text, photos and videos you post. By posting, you give Pet Mafia Club a worldwide, non-exclusive, royalty-free license to host, display, copy, resize and share that content on the Site and in promoting the Site and your listing. You are responsible for the content you post.

8. Moderation and removal

We may review, edit for formatting, refuse, hide or remove any listing or content, and suspend or close any account, at any time and for any reason, including if we believe it breaks these Terms or puts animals or people at risk. We are not required to monitor content, and we don’t verify every listing or user.

9. Fees

Creating an account, searching and posting a basic listing are currently free. We may offer optional paid features in the future. If we do, prices and terms will be shown before you buy, and nothing will be charged without your consent.

10. No warranties

The Site is provided “as is” and “as available”. We don’t guarantee the accuracy of listings, the health, temperament, breed or registration of any animal, the identity or conduct of any user, or that the Site will always be available or error-free. To the fullest extent allowed by law, we disclaim all warranties, express or implied.

11. Limitation of liability

To the fullest extent allowed by law, Pet Mafia Club and its owners, employees and partners will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from transactions or interactions between users, including payments, deposits, the health or condition of any animal, or any fraud by another user. Our total liability for any claim related to the Site will not exceed the greater of the amount you paid us in the 12 months before the claim or US$100.

12. Indemnity

You agree to defend and hold harmless Pet Mafia Club from any claims, losses or expenses (including reasonable attorneys’ fees) arising from your listings, your content, your transactions with other users or your violation of these Terms or the law.

13. Disputes between users

If you have a dispute with another user, you agree to resolve it directly with that user. You release Pet Mafia Club from claims related to such disputes, to the extent allowed by law. We may, but are not required to, help.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Massachusetts, unless the law where you live gives you the right to bring a claim locally.

15. Changes

We may update these Terms from time to time. We will change the “Last updated” date above, and for significant changes we will give notice on the Site. Using the Site after changes means you accept the new Terms.
